The terms for using this site, including price comparison, selling to us and disputes.
These Terms are a legal agreement between you and Labelle Digital LLC, a Florida company that operates GiftCardHawk ("we," "us," "our"). They cover your use of this website and our services (the "Services"). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
We compare gift card prices from independent sellers and help you find the cheapest way to buy an amount. We also buy certain gift cards back. We are an independent business. We are not your broker, agent, bank or financial advisor, and nothing on the site is financial advice.
You must be at least 18, live in the United States and be able to form a binding contract. Keep your sign-in details secure. You are responsible for activity under your account. Give accurate information and keep it current.
We may suspend or close an account, or refuse a request, where we suspect fraud, misuse or a breach of these Terms. You may close your account at any time by emailing us.
Prices, discounts, stock and Deal Finder results are estimates taken from third-party data that changes constantly. Each page shows when its prices were last checked. A price shown here is not an offer by us and may no longer be available when you reach the seller. Discounts are measured against the card's face value. Confirm the final price on the seller's site before you pay.
Errors happen. If a price, balance or listing on this site is wrong, the seller's own checkout controls, and we may correct the error at any time.
For most brands we link to independent sellers that we do not operate or control. Your purchase from a seller is a contract between you and that seller under its own terms, guarantee and privacy policy. We are not a party to it and are not responsible for the seller's products, prices, delivery or conduct. How the site is funded is set out in the Disclosure.
Any figure we give for a card you submit is an estimate. We may revise or withdraw it after we verify the card and its balance. Neither side is bound until we send a written offer, you accept it and the card verifies. You confirm that you lawfully own each card you sell us and that it was obtained legally. We may ask for proof of ownership and identity as described in our AML Policy.

We may verify identity or the source of a card, set limits, and cancel, refuse, delay or report any request we find suspicious. See the AML Policy.
When you set a price alert or send us a form, you agree that we may contact you by email about it. Notices we send by email or post on this site satisfy any legal requirement that a notice be in writing. Every alert email has an unsubscribe link. Alerts depend on third-party data and may be late or missed, so do not rely on them as your only check.
The site's design, text, software and compiled data belong to us. You may use them for personal, non-commercial purposes. Brand and seller names and logos belong to their owners and appear here only to identify the cards and sellers being compared. We are not affiliated with, endorsed by or sponsored by any brand or seller shown on the site. A rights owner with a concern can email support@giftcardhawk.com and we will respond promptly.
The Services are provided "AS IS" and "AS AVAILABLE." To the fullest extent the law allows, we disclaim all warranties, express or implied, including the implied warranties of MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE and non-infringement.
We do not warrant that prices, balances or stock shown are accurate, complete or current, that any seller will honor a price, or that the site will be uninterrupted or free of errors.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost savings or lost data, however caused.
Our total liability for all claims about the Services is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose and (b) $100.
Nothing in these Terms limits liability for fraud, or any liability that cannot be limited by law. Some states do not allow certain warranty exclusions or damage limits, so parts of these two sections may not apply to you.
You agree to cover our losses and reasonable legal costs from any third-party claim caused by your breach of these Terms, your breach of the law, or a card you sold us that you did not lawfully own.
Contact us first. Email support@giftcardhawk.com with a description of the problem, and both sides will try in good faith to resolve it within 30 days before either files a claim.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any claim must be brought in the state or federal courts located in Florida, and both sides accept the jurisdiction of those courts. Either side may use a small-claims court that has jurisdiction.
To the extent the law allows, you and we each waive the right to a jury trial, and each may bring claims only in an individual capacity and not as part of a class or representative action.
A claim must be filed within one year after it arose, unless the law requires a longer period.
These Terms and the policies they link to are the entire agreement between you and us about the Services. If a court finds part of these Terms unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver of it. You may not transfer your rights under these Terms. We may transfer ours to a successor of the business. We may change or end any part of the Services at any time. Neither side is liable for delay caused by events outside its reasonable control.
We post each new version here with a new "last updated" date. For a material change we also email account holders at least 14 days before it takes effect. The version in force when you use the Services applies. If you do not accept a change, stop using the Services.
